Overview
This 2-day workshop will provide a world-class programme, delivered by highly qualified professionals from the tax authority, professional services provider as well as taxpayers, providing an all-rounder perspective of the topic.
Focus shall be on the Transfer Pricing challenges in the developing world (with special focus on Africa) and tax transparency in the post-BEPS era. The new 2017 Transfer Pricing Guidelines (TPG) can be considered a game changer that is expected to change how we currently view transfer pricing outcomes in many situations. This calls for change in how tax authorities approach transfer pricing audits and how multinational companies trade with each other and document such transactions.
To appreciate the ever-changing aspects of transfer pricing and comprehend these challenges, it is essential to fully understand the transfer pricing principles and methodologies and their practical application. There is also need to look at the impact technological advancements will have on transfer pricing in general and how we can leverage on that for efficiencies and accuracy in our documentations.
Learning Objectives
- Appreciate the importance of international transfer pricing to multinational enterprise groups and tax administrations
- Analyse the various Eastern Africa countries’ legal framework for transfer pricing, taking into account international practice and guidance (including the OECD Transfer Pricing Guidelines) and the role of tax treaties
- Kenya as the pioneer in legislating on transfer pricing in East Africa
- Rwanda’s 2018 Draft TP regulations; and
- Tanzania’s 2018 revised guidelines compared to the 2014 guidelines.
- Understand the arm’s length principle, the concept of comparability and the transfer pricing methods in the OECD Transfer Pricing Guidelines.
- Apply the arm’s length principle in practice, based on the guidance provided in the OECD Transfer Pricing Guidelines
- Understand the purpose and content of transfer pricing documentation and gain better insight in the international guidance on this subject.
- Appreciate mechanisms for avoidance and resolution of transfer pricing disputes, including advance pricing agreements, as well as the mutual agreement procedure and arbitration.

The course is suitable for finance and tax personnel of multinational enterprises, tax accountants, economists and lawyers, in-house tax managers, tax and transfer pricing advisers, and government officials.
Continuous Professional Development Units (CPD Units)
Members of ICPAK and those from other reciprocating professional bodies will be awarded 14 CPD Units upon successfully attending all workshop sessions.
